Terms and Conditions

1. Scope

These terms apply to the DocuBuild software (app, desktop) and the website get-docubuild.com – for consumers and businesses.

2. Services

DocuBuild is used to create and manage construction documentation. Scope follows the product description and chosen plan (Solo/Team/Enterprise, monthly subscription).

3. Availability, maintenance and service level

The software works offline – availability of the locally installed app is within the customer's control. For server-side online components (e.g. licence activation, customer portal, billing) we aim for 99% availability on an annual average (target availability). Excluded are announced maintenance windows, emergency maintenance, failures of upstream/infrastructure third parties and force majeure.

4. Liability and liability cap

Unlimited liability for intent and gross negligence and for injury to life, body or health. For slight negligence of essential duties, liability is limited to the foreseeable, contract-typical damage and capped at the fees of the last twelve months (liability cap). Indirect or consequential damages, lost profit, business interruption, construction/schedule delay and data loss are excluded except for intent/gross negligence. Liability under the Product Liability Act and mandatory consumer rights (§§ 327 ff. BGB) remain unaffected.

5. Construction-project risk

DocuBuild supports documentation but is not a substitute for the customer's own data retention, statutory archiving or site due diligence. For damages arising from construction defects, construction/schedule delay, contractual penalties or third-party claims caused by a software failure, we are liable only for intent and gross negligence; the customer must keep their own backups.

6. Warranties

Otherwise provided "as is"; availability beyond section 3 or fitness for a particular purpose is not warranted. Mandatory consumer rights (§§ 327 ff. BGB, Directive (EU) 2019/770) remain unaffected.

7. Prices, term and termination

Prices include VAT. Subscriptions are continuing obligations and renew for the stated term unless cancelled in time. Termination is possible at the end of the term at any time.

8. Right of withdrawal (consumers)

14-day right of withdrawal. For digital content it expires upon express consent and acknowledgement of the loss of that right. Withdrawal via the in-app function.

9. Governing law and forum

German law applies. Forum, where permissible, is Berlin. Mandatory EU consumer forum rights remain unaffected. Reference to the EU online dispute resolution platform.

10. Final provisions

Severability (§ 306 BGB). Changes to these terms only with active consent; silence is not consent. The German version is binding.
